La jurisprudencia del TJUE y del TEDH sobre el Estado de Derecho en Polonia y la reacción del Tribunal Constitucional polaco al respecto han sido ampliamente difundidas en los últimos años. Tiene importancia y consecuencias no para un solo país, sino para los miembros de la Unión Europea y del Consejo de Europa. Por ello, el artículo presenta y analiza la jurisprudencia mencionada e intenta presentar perspectivas posibles, haciendo especial hincapié en las medidas que deben adoptarse para defender el Estado de Derecho.

The jurisprudence of the CJEU and the ECHR concerning the rule of law in Poland and the reaction of the Polish Constitutional Court to the above has been widely publicised over the last few years. It has significance and consequences not for one country, but for the members of the European Union and the Council of Europe. Hence, the article presents and discusses the above-mentioned case law and attempts to present further perspectives, with particular emphasis on actions to be taken to uphold the rule of law.
