The comment is inspired by a very recent ruling by the European Court of Human Rights relating tothe violation of art. 8 ECHR. The story, analyzed in its complexity, highlights the need to examine various criminological issues, in particular domestic violence, ill-treatment, threats, secondary victimization and the malevolent mother syndrome, also raising GREVIO’s concerns in the latter case for the now widespread practice of considering the mother who refuses to meet her children with their father as an unsuitable parent

Il commento trae spunto da una recentissima pronuncia della Corte Europea dei Diritti Umani relativaalla violazione dell’art. 8 CEDU. La vicenda, nella sua complessità, ha costretto la Corte ad affrontare diverse tematiche criminologiche, in particolare la violenza domestica, i maltrattamenti, le minacce, la vittimizzazione secondaria e la sindrome della madre malevola, sottolineando, in quest’ultimo caso, anche le preoccupazioni del GREVIO per la prassi ormai diffusa volta a considerare la madre, cherifiuta gli incontri dei figli con il padre, come genitore inadatto
