Resumen de Breves considerações a respeito das teorias relativas ao reconhecimento da personalidade jurídica e sua aplicabilidade à proteção do ser humano em gestação

  O reconhecimento como pessoa é condição essencial para que o indivíduo seja protegido pelo ordenamento jurídico. Discute-se, com base nas categorias de pessoa, personalidade, e capacidade, a possibilidade de inclusão, no rol de sujeitos protegidos, do ser humano em processo de gestação. Após análise das teorias civilistas dedicadas ao tema - natalista, concepcionista e personalidade condicional -  e, com o auxílio do método dedutivo e pesquisa bibliográfica, são estabelecidas as bases para a solução da questão proposta, qual seja, a coincidência do início da proteção jurídica ao início da existência física do indivíduo, aqui entendido como o momento da concepção. Conclui-se que a opção por momento diverso tornaria o início da proteção jurídica do ser humano um evento arbitrário e equivaleria a tornar possível a divisão dos seres humanos entre os seres pessoais e os não-pessoais.

  Be recognized as a person is a condition that allows the individual to be protected by the law. It is argued, based on the categories of person, personality, and capacity, the possibility of inclusion in the list of protected individuals, the human being in the process of gestation. After analysis of the private law theories about the theme –natalist, conceptionist and conditional personality –and, with the help of the deductive method and literary research, havelaid the foundations for the answer of the proposed question, namely, the coincidence of the start of the legal protection as the same as the physical existence of the individual, here understood as the moment of conception. We conclude that the choice ofa different moment would become the beginning of the legal protection of the human being an arbitrary event and would make possible the division between human beings personal and non-personal.
