Resumen de Alcances de la inteligencia artificial como expresion de la voluntad y/o mandato del que utiliza esta herramienta respecto a terceros y usuarios

  El presente trabajo asociado al Derecho Digital pretende dar una aproximación al uso de la inteligencia artificial (en adelante IA) asociada a aquellos usuarios que se valen de esta tecnología (en adelante USUARIOS PRESTADORES –UP) respecto a TERCEROS USUARIOS (en adelante T.U) que acceden a bienes y servicios en un amplio espectro integrados mediante procedimientos automatizados por algoritmos I.A.Es de destacar que como cita normativa en la materia, la relación existente entre diferentes niveles de proveedores de herramientas de IA (proveedor, responsable del despliegue, representante autorizado, importador, distribuidor, operador entre otros) , nos ocuparemos específicamente en esta oportunidad por tener particular interés jurídico su abordaje, en aquella que vincula a un proveedor y/o usuario de herramientas de IA analizando si la ejecución de procesos algorítmicos bajo el formato de IA, por sus consecuencias jurídicas, son válidas como expresión de la voluntad del UP hacia el T.U. y si convalidan actos con efectos jurídicos susceptibles de generar responsabilidades y/o pueden representar un mandato según la complejidad o autonomía del algoritmo bajo la modalidad de IA

  The present work associated with Digital Law aims to give an approach to the use of artificial intelligence (hereinafter AI) associated with those users who make use of this technology (hereinafter USERS PROVIDERS -UP) with respect to THIRD PARTY USERS (hereinafter T.U) who access goods and services in a broad spectrum integrated through automated procedures by A.I. algorithms.It is noteworthy that as a normative citation in the matter, the existing relationship between different levels of suppliers of AI tools (supplier, responsible for the deployment, authorized representative, importer, distributor, operator among others), we will deal specifically in this opportunity for having particular legal interest in its approach, in that which links a supplier and/or user of AI tools analyzing whether the execution of algorithmic processes under the format of AI, for its legal consequences, are valid as an expression of the will of the UP towards the T. U. and if they validate acts with legal effects susceptible of generating liabilities and/or may represent a mandate according to the complexity or autonomy of the algorithm under the AI modality
