Resumen de Posverdad jurídica, lawfare y nuevas dimensiones del derecho a la verdad

    A partir de los aportes del cognocitivismo jurídico y el garantismo actual, se analizarán las nuevas dimensiones del derecho a la verdad bajo el contexto del Lawfare y la Posverdad en nuestra región latinoamericana. Para ello, luego de un somero análisis de los dos fenómenos antes mencionados, se problematizará sobre la verdad jurídica y sus alcances dentro de los debates actuales sobre memoria, verdad y justicia, contribuyendo a la discusión sobre la necesidad de reformar el poder judicial en miras de una sociedad democrática que garantice la no repetición del Lawfare, evitando las arbitrariedades del poder judicial.

  Based on the contributions of legal cognocitivism and guarantee mouvement, the new dimensions of the right to the truth will be analyzed in the context of phenomena such as Lawfare and Post-truth in our Latin American region. To do this, after a brief analysis of the two aforementioned phenomena, will discuss the legal truth and its scope within the current debates on memory, truth and justice, contributing to the discussion on the need to reform in view of a democratic society that guarantees the non-repetition of Lawfare, avoiding the arbitrariness of the judiciary.
