Resumen de Redução das doações inoficiosas na doutrina

  The present article aimed at presenting different opinions ofexperts regarding the legal rules established by the Civil Code of 2002 about the reduction of invalid donations, through a bibliographic search. It was possible to identify that there are several sensitive topics on the subject, about which experts have dissonant views: (1) the moment when the donation becomes invalid –when the donation was negotiated, or when the donor died; (2) how to carry out the reduction –in substance, or by estimation; (3) when to assess the value of the asset when the reduction is carried out by estimation; (4) when to discuss the reduction –while the donor is alive or only after his death; (5) if there is a deadline for claiming the reduction. The article came to the conclusion that the legal rules on the reduction of invalid donations in the Civil Code of 2002 is quite complex, with each of the several rules established by section 2.007 giving rise to significant controversies

  O presente artigo teve como objetivo apresentar um quadro diagnóstico sobre o posi-cionamento doutrinário em relação à interpretação e aplicação das normas do Código Civil de 2002 acerca da redução das doações inoficiosas, por meio de uma pesquisa bibliográfica. Foi possível identificar que há vários pontos sensíveis em relação ao tema, sobre os quais existem entendimentos dissonantes na doutrina: (1) momento de apuração da inoficiosidade, tempo da doação ou da abertura da sucessão; (2) forma de se proceder à redução –em substância, ou por estimação; (3) momento de aferição do valor do bem quando a restituição se der por estimação; (4) momento para se pleitear a redução, em vida do doador, ou apenas após a sua morte; (5) prazo para se pleitear a redução. Concluiu-se que a disciplina da redução das doações inoficiosas no Código Civil de 2002 é bastante complexa, com cada uma das diversas regras estabelecidas no art. 2.007 ensejando significativas controvérsias doutrinárias
