El arbitraje inversionista-Estado (ISDS, por su sigla en inglés) ha evolucionado fuertemente desde la segunda mitad del siglo XX a la actualidad. El que fuera el mecanismo de solución de controversias predilecto, enfrenta desde hace dos décadas críticas procedimentales y sustantivas respecto a su idoneidad. El estado actual de la discusión acerca del ISDS se ve reflejado en las negociaciones y en los tratados de inversión y de libre comercio: la Unión Europea, Canadá, Australia y Estados Unidos han excluido el arbitraje de inversiones de sus tratados. El presente ensayo presentará una evolución del ISDS, tanto en el debate académico como en los textos de los tratados internacionales; y ofrecerá algunas interpretaciones que buscan explicar esta evolución.

Investor-State arbitration (ISDS) has significantly evolved from the second half of the 20th century to the present day. Once the preferred mechanism for dispute resolution, it has faced procedural and substantive criticism regarding its suitability over the past two decades. The current state of the discussion on ISDS is reflected in the negotiations and investment and free trade treaties: the European Union, Canada, Australia, and the United States have excluded investment arbitration from their treaties. This essay will present an overview of the evolution of ISDS, both in academic debate and in the texts of international treaties, and will offer some interpretations that aim to explain this evolution.
