García Goyena y Bello: tradición y ruptura en la codificación chilena. Reconstrucción del proceso de redacción del Código Civil chileno, sus fuentes y su historia dogmática

    Esta tesis propone una relectura y recontextualización del proceso de formación del Código Civil chileno y de sus fuentes, como instrumento de interpretación de su articulado y de la cultura e ideas que tras él se plasmaron. Si bien hasta la fecha contamos con una “historia externa” del proceso de redacción del texto, es decir, su proceso de formación a partir de comunicaciones oficiales, y una “historia interna” referida a las fuentes y contenido dogmático del contenido de cada disposición del Código, éstas no logran explicar diversas inconsistencias entre las redacciones “oficiales” y los contenidos y fuentes que históricamente se han establecido como tales. Para solucionar los problemas se usó la obra de García Goyena como un marcador o baremo, porque así fue utilizada por Bello desde al final de la redacción del Proyecto de 1853, y porque ambos codificadores estaban vinculados cultural e ideológicamente. Con este contraste se pudo revisar críticamente los textos publicados hasta la fecha, además de releer y reorganizar los manuscritos de Bello que se encuentran en la Casa Central de la Universidad de Chile y en otros archivos nacionales. Comprobaremos que entre España y Chile existió una comunidad cultural, dogmática, política e ideológica previa a la codificación y que ella permitió concretar un código que, por un lado, reflejó los ideales liberales de la modernidad, pero que también fue un continuador del derecho tradicional. Así, en la tesis analiza cómo la obra de Goyena permeó la cultura jurídica en el S. XIX en los principales canales de comunicación institucional, como en las revistas jurídicas y libros de la época, y también cómo su lectura permitió completar el proceso de redacción del Código Civil y su interpretación

    This thesis proposes a reinterpretation and recontextualization of the formation process of the Chilean Civil Code and it’s sources, as an instrument of interpretation of it’s articles and the culture and ideas that were embodied in this Code. Although today we have an "external history" of the drafting process of the text, the formation process based on official communications, and an "internal history" referring to the sources and dogmatic content of each article of the Code, they fail to explain several inconsistencies between the "official" texts and the contents and sources that have historically been established by the literature. To solve the problems, the books of García Goyena was used as a marker or scale, because that was how it was used by Bello from the end of the writing of the 1853 Project, and because both codifiers were culturally and ideologically linked. With this contrast, it was possible to critically review the texts published, in addition to rereading and reorganizing Bello's manuscripts found in the Central House of the University of Chile and in other national archives. We will verify that between Spain and Chile there was a cultural, dogmatic, political and ideological community before the codification and that it allowed the realization of a code that, on the one hand, reflected the liberal ideals of modernity, but was also a continuation of traditional law. The thesis analyze how Goyena's books permeated the legal culture in the 19th century in the institutional communication channels, as in legal journals and books, and also how it’s reading allowed to complete the writing process of the Civil Code and it’s interpretation
