La inclusión de las empresas del sector del transporte comercial aeronáutico en el Régimen general de control relativo a los mercados de derechos de emisión de gases contaminantes ha abierto una compleja controversia. A su vez, en el estudio del caso que se ofrece, se va a entrar a conocer el impacto de esta controversia en el sector turístico. Sirve esta controversia para que a través del caso comparado se describa la observación de las dinámicas legales procedentes de la Comisión Europea en aras a la creación de un régimen de mercado de derecho de emisiones de carácter global.
Since Directive 2008/101/CE, the European Union has included commercial aviation in the general European Trade System that aims to curb greenhouse gases emissions. This unilateral decision has led to a growing controversy that justifies itself by the relevance of this study. The current thesis proposes in-depth research about the legitimacy, validity and efficacy of this measure. Such a move provoked a reaction in other countries such as the USA and China and also within the commercial aviation industry. Also, and as far as this case study is concerned, the impact of such controversy in the tourism sector will be researched. This sector is of particular relevance in the European economies. Furthermore, this is an interdisciplinary study with a legal basis and is also connected with other social sciences where research techniques belonging within the law and legal sciences have been used. To display and explain the aforementioned controversy offering an opinion based in similar, already resolved disputes is also the intention of this study. This will hopefully add to the resolution of the current matter at hand.
