La presente tesis doctoral propone la teoría de la determinación en sentido general del concepto de Interés Público, orientada a construir en sede constitucional el principio autónomo de interés público, en defensa de los principios de seguridad jurídica, tutela judicial efectiva, juridicidad y empoderamiento del poder constituyente primario. Afirmamos en este escrito que el interés público como concepto jurídico indeterminado es una institución inútil para afrontar las complejidades asociativas, debido a la amplitud de subjetividad. La inoperancia de este concepto jurídico indeterminado, se resuelve con la admisión de un tipo de concepto que osamos denominar: concepto jurídico de determinación en sentido general, del cual se desprende, por un lado, el reconocimiento de la exigencia jurídica y democrática que en la constitución política se estipule textualmente el concepto de interés público, con lo cual se resolvería la amplitud de determinación que gozan tanto la administración como el juez (Amplitud de subjetividad), y por el otro, que de esto se desprenda una nueva causal de control de las actuaciones de la administración, que denomínanos: lesión al interés público.
