    One can say that the emergence of society occurs through relationships of agreement between humans, culminating in the existence of political society, which is a more organized form which preceded another better structured form called state. At this point, new organizational ramifications with new ideas are developed, among them two of paramount importance, namely the Rule of Law and the Social State, which served as the basis for structuring the Democratic State of Law. Finally, turning to the legal fi eld, we analyze the function of the Judiciary in that state model through a few examples and critical analyses.Keywords: political society, social state, rule of law, democratic rule of law, access to justice, judicial activism.

    Pode-se dizer que o surgimento da sociedade se dá por meio de relações de acordo entre os seres humanos, o que culminou na existência da sociedade política, sendo esta uma forma mais organizada que antecedeu outra forma ainda mais bem estruturada denominada de Estado. Neste ponto, novas ramificações organizacionais com novos ideais vão sendo desenvolvidos; entre eles, dois são de suma relevância, o Estado de Direito e o Estado Social, que serviram de base para a estruturação do Estado Democrático de Direito. Por fim, voltando-se à área jurídica, analisa-se o papel do Poder Judiciário em tal modelo estatal por meio de alguns exemplos e análises críticas.Palavras-chave: sociedade política, Estado Social, Estado de Direito, Estado Democrático de Direito, acesso à justiça, ativismo judicial.
