    Sometimes when the biological parents don’t cooperate, the parentage establishment may be forced and that may collide with some constitutional grounds. In these cases, in spite of the child's interest in seeing their parentage established, there are still constitutional boundaries that must be respected. However, not all countries have the same approach in these cases. Therefore, we believe that is important to discuss the constitutional issues that take place in this discussion and what solutions have been reached by the doctrine and jurisprudence

    Por vezes, quando falha a colaboração dos progenitores, o estabelecimento da filiação poderá ser forçado e tal pode vir a contender com algumas questões constitucionais. Nestes casos, apesar do superior interesse do filho em ver os seus laços estabelecidos, existem limites constitucionais que devem ser respeitados. Todavia, nem todos os países adotam a mesma bitola nestes casos. Importará discutir quais os direitos constitucionais em confronto nos casos do estabelecimento da progenitura biológica e quais as soluções a que a doutrina e jurisprudência têm chegado.
