Prova e jurisdicionalismo no novo cpc brasileiro

    Based on the logical-deductive method of critical rationalism of Karl R. Popper, the text tests the hypothesis that the New Brazilian Code of Civil Procedure polysemies around the evidence, already contained in the 1973 Code of Civil Procedure keeps untouched the inability to systematize the institute. It presents arguments aimed at supporting the assertion that the conceptual confusion of the new code is derived primarily from its theoretical foundations, which still renders homage to the lessons of pseudoscientific processualism of Oskar von Bülow. From there, it concludes that the New Brazilian Code of Civil Procedure only radicalizes the judicial solipsism already present in the 1973 Code, nothing collaborating for the implementation of the constitutional democracy provided for in the Constitution of 1988.

    Com base no método lógico-dedutivo do racionalismo crítico de Karl R. Popper, o texto busca testar a hipótese de que o Novo Código de Processo Civil brasileiro reproduz polissemias em torno da prova já presentes no Código de Processo Civil de 1973, mantendo intocada, exatamente por isso, a impossibilidade de sistematização do instituto. Para tanto, apresenta argumentos que visam a sustentar a afirmação de que as confusões conceituais do novo código derivam, basicamente, de seus fundamentos teóricos, os quais ainda rendem homenagens às lições pseudocientíficas do processualismo de Oskar von Bülow. A partir daí, conclui que o Novo Código de Processo Civil brasileiro apenas radicaliza o solipsismo judicial já presente no Código de 1973, em nada colaborando para a implementação da democraticidade jurídica pretendida pela Constituição de 1988.
