  El presente trabajo tiene como finalidad el estudio de una figura protegida desde hace tiempo por el Derecho, la memoria defuncti. Tutelada de manera expresa desde hace más de 35 años, las vulneraciones a la misma sufren actualmente una mayor visibilidad gracias a las nuevas tecnologías y al acceso de los ciudadanos a las redes sociales. El estudio ofrece una reflexión acerca de la propia definición de esta figura, especialmente vulnerable puesto que los difuntos ya no se pueden defender, especificará qué integra la protección de la misma puesto que los fallecidos no tienen derechos, he aquí el problema, y analizará por qué sobrevive a la muerte de la persona. Para ello principalmente se examinarán los aspectos relativos a la misma contenidos en la Ley Orgánica 1/1982, de 5 de mayo, de protección civil del derecho al honor, a la intimidad personal y familiar y a la propia imagen; y el criterio de nuestros Tribunales. En definitiva, el objetivo del estudio es reflejar la necesidad e importancia de tutela que, con mayor motivo hoy en día, precisa esta figura

  The present work has the purpose of studying a figure protected for a long time by Law, memory defuncti. Overseen for more than 35 years, violations of it currently suffer greater visibility thanks to new technologies and citizens» access to social networks. The study offers a reflection on the very definition of this figure, especially vulnerable since the deceased can no longer be defended, will specify what the protection of the deceased integrates since the deceased have no rights, here is the problem, and will analyze by what survives the death of the person. For this purpose, the aspects related to it contained in Organic Law 1/1982, of May 5, civil protection of the right to honor, personal and family privacy and to one’s own image will be examined; and the criteria of our Courts. In short, the aim of the study is to reflect the need and importance of guardianship, which, with greater reason today, requires this figure.
