O Direito como pressuposto do horizonte literário: uma nova compreensão da realidade jurídica

    Neste artigo, pretende-se desenvolver uma reflexão da importância da literatura no direito de família a partir das narrativas de Sartre e da teoria dos sistemas. O método da pesquisa é teórico sistêmico que se dá pela abordagem sociológica, tanto conceitual quanto empírica dos sistemas jurídicos. O objetivo sempre foi buscar a conexão sistêmica entre a comunicação social, o direito e a literatura, observando as redes que geram relações familiares, que são emotivas e por isso extremamente complexas e ressignificadas. A pesquisa mostra como resultante que o sentido não pode ser restrito de forma analítica a legislação crua, mas cognitivamente abertos à pragmática decisória dos contextos fáticos, perante a instituição do imaginário coletivo. As considerações finais apontam para a possibilidade, por meio da literatura, que setores sociais percebam situações políticas, filosóficas e inclusive de autonomia, nunca vivenciadas. Assim o sistema social força o Estado a incluir a afetividade como fonte da normatividade, inspirada pela literatura de Sartre, perante o Muro das expectativas comportamentais, institucionalizando, por exemplo, o reconhecimento das novas constituições familiares se modifica de acordo com a realidade atual.

    This paper aims to know the reality of public health financing in the Recôncavo da Bahia region, considering it in the context of the political-administrative structure of the Brazilian State. The research developed for this purpose has both bibliographic, documentary and empirical character, based on specialized doctrine and legislation, and on the use of the data available in the Transparency Portal of the Ministry of Health, and the Information System on Public Health Budgets ( SIOPS) in the first semester of 2016. From a critical perspective, we seek to present the reality of health financing and the peculiarities of each municipality in the territory under consideration, based on the constitutional assumption that health is a fundamental right , which must be offered in full, with quality and respect for human dignity, always according to indices established both by the current legislation and by specialized agencies
