Resumen de As formas de organização administrativa de Brasil e Portugal para prestação de assistência jurídica gratuita: análise comparada

  O presente trabalho analisa de forma comparada como Brasil e Portugal se organizam para efetivar a garantia de acessibilidade ao Poder Judiciário para pessoas em situação de insuficiência econômica. São vários os problemas de efetividade do direito de acesso à justiça em ambos os países, fazendo necessário estruturas organizacionais especificas que possibilitem o efetivo exercício desse direito. No Brasil, a assistência jurídica integral e gratuita aos hipossuficientes é direito e garantia fundamental ao cidadão, conforme inserido no art. 5° da Constituição da República, no inciso LXXIV. Essa assistência é imposta à União, aos Estados e ao Distrito Federal através da Defensoria Pública, determinando que esta seja instalada em todo o país, nos moldes da lei complementar nº 132/2009, prevista no parágrafo único do art.134. Os juristas são recrutados por concurso e integrados em carreiras com vínculo profissional às Defensorias Públicas estaduais ou à Defensoria Pública da União. Por sua vez, em Portugal é adotado um regime de apoio judiciário privado e liberal onde a defesa jurídica é assegurada por profissionais autónomos, nomeados pela entidade que os representa, no caso a Ordem dos Advogados. Este modelo é financiado pelo Estado e também pelos beneficiários quando estes mostram que têm algumas posses económicas.

  The present work analyzes in a comparative way that Brazil and Portugal organize themselves to guarantee accessibility to the Judiciary for people in a poor economic situation. There are several problems in effectiveness of the right of access to justice in both countries, making specific organizational structures necessary to enable the effective exercise of this right. In Brazil, full and free legal assistance to low-income individuals is a fundamental right and guarantee to citizens, as inserted in art. 5 of the Constitution of the Republic, in item LXXIV. This assistance is imposed on the Union, the States and the Federal District through the Public Defender's Office, determining that it be installed throughout the country, in accordance with the complementary law No. 132/2009, provided for in the sole paragraph of art.134. Lawyers are recruited by competitive examination and integrated into careers with a professional relationship with the State Public Defenders or the Public Defender of the Union. In Portugal, a system of private and liberal legal aid is adopted where independent professionals, appointed by the entity representing them, in this case, provide the Bar Association legal defense. This model is financed by the State and by the beneficiaries when they show that they have some economic assets.
