    The main scope of this study is to identify the legal grounds for disgorgement of wrongful gains on the Spanish legal system, as well as the quantitative criteria established on such system when taking into consideration a possible restitution of wrongful gains to the lawful holder of such gains. By means of descriptive research, the paper analyzes the framework and the limits to disgorgement of wrongful gains established by Spanish scholars and legislation.

    In this sense, it is possible to imply that Spanish scholars understand disgorgement of wrongful gains as a form of unjust enrichment. On the other hand, specific laws on immaterial rights have included disgorgement of wrongful gains as a criteria in order to assess damages. Finally, court precedents are inconclusive on this matter.

    O escopo central do presente estudo consiste em identificar o fundamento técnico conferido ao lucro da intervenção no ordenamento jurídico espanhol, bem como os critérios quantitativos utilizados em eventual restituição ao titular do direito. A partir do processo descritivo, o artigo observa o tratamento e os limites conferidos ao lucro da intervenção pela doutrina espanhola e as soluções traçadas pelo legislador espanhol. Conclui-se que a doutrina defende que o lucro da intervenção é modalidade de enriquecimento sem causa e o legislador no âmbito dos direitos imateriais o inseriu como hipótese no cálculo das indenizações. A jurisprudência, por fim, mostra-se inconsistente.
