    This paper aims to discuss the contrast between natural law and positive law, as well as to briefly discuss the formation-construction of legal positivism in the German, French and English traditions and their relations with the Historical, Exegese and Portuguese Schools. Common Law. In addition, this study will analyze the Kelsenian Normativist Positivism, emphasizing that, as legal positivism in Brazil is discussed, and judicial discretion, the mistaken reception of foreign legal theories is evident. For this, a phenomenological-hermeneutic approach methodology, methods of historical and monographic procedure will be used, together with the technique of research by indirect documentation.

    O presente trabalho tem como objetivo discorrer acerca da contraposição entre direito natural e direito positivo, assim como discutir, brevemente, a formação-construção do positivismo jurídico nas tradições alemã, francesa e inglesa e as suas relações com as Escolas Histórica, da Exegese e da Common Law. Além disso, analisar-se-á, neste estudo, o Positivismo Normativista Kelseniano, enfatizando que, na medida em que se discute o positivismo jurídico no Brasil, e a discricionariedade judicial, se evidencia a recepção equivocada de teorias jurídicas estrangeiras. Para isso, será utilizada uma metodologia de abordagem fenomenológico-hermenêutica, métodos de procedimento histórico e monográfico, juntamente com a técnica de pesquisa por documentação indireta.
