Lacunas jurídicas e crimes informáticos: comentários sobre o tratamento acerca do crime de pornografia infantil na internet

    This article analyzes the evolution of jurisprudence in the treatment of the crime of child pornography practiced on the internet, especially through Habeas Corpus n. 76.689-0/PB. To this end, a bibliographic review of the theme of legal gaps from the perspective of Criminal Law and computer crimes is carried out, under the prism of the fundamentals and distinctions between application, interpretation, integration and construction. In the end, it is understood that in partly there is no gap in the Brazilian legal system, with digital networks being only a new means for the practice of the crime of child pornography, sufficiently regulated by the Penal Code and extravagant legislation.

    O presente artigo analisa a evolução jurisprudencial no tratamento do crime de pornografia infantil praticado pela internet, sobretudo através do Habeas Corpus n. 76.689-0/PB. Para tanto, é realizada uma revisão bibliográfica do tema das lacunas jurídicas na perspectiva do direito penal e dos crimes informáticos, sob o prisma dos fundamentos e distinções entre aplicação, interpretação, integração e construção. Ao final, entende-se pela inexistencia, em parte, de lacuna no ordenamento jurídico brasileiro, sendo as redes digitais apenas um novo meio para a prática do crime de pornografia infantil, suficientemente regulados pelo Código Penal e legislação extravagante.
