Nas entrelinhas da cidadania: o especismo na constituição brasileira de 1988

    This article investigates animal’s protection in the Brazilian constitutional sphere, observing the possible presence of speciesist aspects, that is, aspects that denote unequal treatments to species. The study was conducted through the analysis of statements of the Federal Constitution that are relevant to the theme, together with bibliographic and legislative reviews. Thus, we attempted to elucidate the concept of speciesism and to examine the pertinent constitutional statements from the perspective of several authors in order to observe which is the correlation between both perspectives. The result indicated that all the analyzed regulations illustrate at least one speciesist characteristic. Therefore, we conclude that the Constitution is speciesist both in protecting certain species to the detriment of others and in encouraging activities of animal exploitation aiming at the welfare of humanity.

    O presente estudo se propõe a investigar a tutela dos animais na esfera constitucional brasileira, observando a possível presença de aspectos especistas, ou seja, que denotam tratamentos desiguais às espécies, por meio da identificação e interpretação dos enunciados da Constituição Federal relevantes ao tema. Conduzida a partir de revisões bibliográficas e legislativas, a pesquisa intentou, primeiramente, elucidar o conceito de especismo e, em seguida, examinar os enunciados constitucionais pertinentes sob a ótica de diversos autores para, por fim — partindo de um panorama conjunto —, observar qual a correlação existente entre ambas as perspectivas. Como resultado, entendeu-se que todas as normas analisadas ilustram ao menos uma característica especista. Concluiu-se, portanto, que a Constituição é especista tanto ao proteger certas espécies em detrimento de outras quanto ao positivar atividades exploratórias de animais visando o bem-estar da humanidade.
