Decisão jurídica e inteligência artificial: um retorno ao positivismo

    A pesquisa procura debater a transferência do processo de decisão jurídica para uma máquina constituída por inteligência artificial. A priori, o objetivo é apresentar as bases teóricas do positivismo jurídico e os problemas enfrentados pelo raciocínio mecanicista implantado ao processo jurisdicional pela Escola da Exegese. A partir daí, será demonstrado como a inteligência artificial possui, em sua essência, uma inteligência lógico-matemática. O terceiro objetivo é fazer uma relação entre a inteligência artificial e o positivismo jurídico do Século XIX. Para o estudo, adotou-se a pesquisa bibliográfica, através de uma metodologia analítica, com caráter qualitativo e método dedutivo. Ao final, conclui-se que transferir o processo decisório para os softwares inteligentes poderá causar um retrocesso ao direito, pois existe a possibilidade do retorno a um positivismo jurídico com a roupagem da atualidade e a reimplantação de um sistema mecanicista para o direito.

    The research seeks to debate the transfer of the legal decision process to a machine equipped with artificial intelligence. At first, the objective is to present the theoretical bases of legal positivism and the problems faced by the mechanistic reasoning implanted in the legal proceedings by the School of Exegesis. From there, it will be demonstrated how artificial intelligence is, in its essence, a logical-mathematical intelligence. The third objective is to establish a relationship between artificial intelligence and legal positivism in the 19th century. For the study, it was used the bibliographic research, through an analytical methodology, with qualitative character and deductive method. At the end, it is concluded that transferring the legal decision process to intelligent software may cause a retrogression to the Law, as there is the possibility of return to a legal positivism with the current characteristics and the reimplantation of a mechanistic system to the law.
