O procedimento sumaríssimo no processo penal brasileiro: Juizado Especial Criminal - algumas considerações

  • Our goal in writing this text is to examine the main existing institutes of Law No. 9,009/95, in order to allow a systematic overview of the Special Criminal Courts. One can not fail to mention also the reflections of Law No. 11.313/06, that adding new text to the text of art. 61 of Law No. 9.099/95 has raised new questions for the institutes of criminal transaction and for the suspension of the proceeding pertains to grant of such extension of benefits for crimes whose minimum sentences will not exceed two years. Also one can not forget the changes introduced by Law No. 11.719/08 to reshape almost the entire chapter on procedures in the Code of Criminal Procedure. Thus, through the new system adopted, the Special Courts became part of the procedure without a change in the very Law No. 9.099/95.
