Compliance nas forças armadas como evolução do sistema do direito no tocante ao acoplamento estrutural com o sistema da política e como irritação em relação ao subsistema do direito castrense

    Based on a bibliographical review, the article intends to analyze the integrity programs (compliance) of the Armed Forces under the sociological perspective of Systems Theory elaborated by the German Niklas Luhmann. It addresses the complexity of modern society from the perspective of the relationship between civilians and the military and its peculiar communications; the importance of social control of institutions through whistleblower channels and the protection of whistleblowers in good faith; the evolution of the military law subsystem in relation to the fight against corruption, with the institution of integrity programs of the three Armed Forces; the autopoiesis in the structural coupling between politics and the military law subsystem in the Brazilian Navy (MB) and in the Brazilian Air Force (FAB);

    the operational and cognitive closure that occurred in the case of the Brazilian Army (EB); and the paradox of the MB and FAB integrity programs in relation to the symbology operated by the EB integrity program, generating a risk of allopoiesis.

    Finally, it will conclude on the possibility that systemic irritations in the military legal subsystem of the EB may change its self-reference, opening itself cognitively to meet the expectations of the political system, performing a structural coupling.

    A partir de uma revisão bibliográfica, o artigo pretende analisar os programas de integridade (compliance) das Forças Armadas sob a perspectiva sociológica da Teoria dos Sistemas elaborada pelo alemão Niklas Luhmann. Aborda a complexidade da sociedade moderna sob o viés da relação entre civis e militares e de suas comuniações peculiares; a importância do controle social das instituições por meio de canais de denúncias e da proteção do denunciante de boa-fé; a evolução do subsistema do direito castrense em relação ao combate à corrupção, com a institução dos programas de integridade das três Forças Armadas; a autopoiese no acoplamento estrutural entre a política e o subsistema do direito castrense na Marinha do Brasil (MB) e na Força Aérea Brasileira (FAB); o fechamento operacional e cognitivo ocorrido no caso do Exército Brasileiro (EB); e o paradoxo dos programas de integridade da MB e da FAB com relação à simbologia operada pelo programa de integridade do EB, gerando um risco de alopoiese. Por fim, concluirá sobre a possibilidade de que as irritações sistêmicas no subsistema jurídico castrense do EB poderão alterar sua autorrefência, abrindo se cognitivamente para atender as espctativas dos sistemas político, realizando um acoplamento estrutural.
