    This paper is dedicated to the theme "Smoking: application of the theory of logic of reason in the contemporary legal context", focusing on the examination from the theory of logic of reason and the systemic view of law. Adopting a deductive approach, during the course of the exposition, in the first moment, the theory of the logic of reason or logic of equity will be demonstrated as a mechanism, or not, of legal security. Subsequently, the article will attempt to highlight the social function of law with the intention of seeking an answer, in order to objectively demonstrate what the law is designed for. Finally, based on the theoretical references discussed, the intention will be to approach the content in a practical way, presenting a concrete case.

    O presente trabalho dedica-se ao tema “Tabagismo: aplicação da teoria da lógica do razoável no contexto jurídico contemporâneo”, com foco no exame a partir da teoria da lógica do razoável e da visão sistêmica do direito. Com a adoção de uma abordagem dedutiva, no decorrer da exposição, no primeiro momento, será demonstrado a teoria da lógica do razoável ou lógica da equidade enquanto mecanismo, ou não, de segurança jurídica. Posteriormente o artigo cuidará de evidenciar a função social do direito com a intenção de buscar uma resposta, no intuito de demonstrar, objetivamente, para qual o direito se presta. Por fim, a partir dos referenciais teóricos abordados, o intento passará a ser uma abordagem do conteúdo de forma prática, sendo apresentado, para tanto, um caso concreto.
