    The object of this article is to analyze the hermeneutics with the decision of the Federal Supreme Court (STF) that equated racial insult with racism for purposes of imprescriptibility. For this analysis, the work will be divided into three points: in the first part, the general aspects of the hermeneutics concept will be seen. Afterwards, the decision of Habeas Corpus No. 154,248 will be discussed. And finally, a criticism will be made of the decision of the Federal Supreme Court, where the merits of the matter and the illegitimacy of the decision will be seen, where we will analyze the problem of the illegitimate judicial activism of HC nº 154.248.

    O presente artigo tem como objeto a análise da hermenêutica junto a decisão do Supremo Tribunal Federal (STF) que equiparou a injúria racial ao racismo para fins de imprescritibilidade. Para essa análise, o trabalho será dividido em três pontos: na primeira parte, serão vistos os aspectos gerais do conceito da hermenêutica. Após será abordada a decisão do Habeas Corpus n° 154.248. E por fim, será feita crítica à decisão do Supremo Tribunal Federal onde serão vistos o mérito da questão e a ilegitimidade da decisão onde analisaremos o problema do ativismo judicial ilegítimo do HC nº 154.248.
