A revisão de literatura sobre as interações entreempresas (mercado), política (Estado) e direito (jurisdição) resulta no questionamento sobre o papel dos notários e o seu impacto nessa questão, pois se constatou que o seu papel extravasa os limites do sistema jurídico, produzindo efeitos para o mercado e para o Estado. Tendo isso em mente e considerando as diferenças entre civil e common law, este artigo pretende analisar se os notários brasileiros, figuras típicas dos sistemas jurídicos continentais, atuam como gatekeepersdo mercado, que são figuras essencial-mente parte do common law. Utiliza-se o método dedutivo e a metodologia é tanto qualitativa quanto quantitativa, baseando-se numa pesquisa bibliográfico-documental. Conclui-se que as características do gatekeepersão plenamente compatíveis com a figura do notário brasileiro, pois essa atividade emprega habilidades variadas e tem um papel complexo no ordenamento jurídico, atuando como agentes responsáveis por um controle preventivo de legalidade. Na realidade, a imparcialidade e a independência conferem aos notários atribuições amplas que extrapolam tanto o controle preventivo de legalidade quanto os pressupostos que a doutrina estabelece para os gatekeepers.
The exam of a literature on the interactions between companies (market), politics (State) and law (jurisdiction) results in the questioning if the notaries have any impact on that, because their role crosses the boundaries of their legal system, having effects over the market and the State. Having it in mind and considering the differences between civil and common law systems, this article aims to analyse if the Brazilian notaries, who are related to civil law, act as market gatekeepers,who are typically part of the common law tradition. By using the deductive method, the methodology is both qualitative and quantitative, based on bibliographic-documen-tal research. In conclusion, we realize that the features of the gatekeepers are plainlycompatible with the Brazilian notaries, since this activity uses many abilities and has a complex role in the Brazilian legal system as agents in charge of preventive legality control. Impartiality and inde-pendence actually provide the notaries broad attributions that go beyond the preventive legality control and what literature describes as gatekeepers.
