    Arbitration as an institution has existed in Brazil since the Colonial Age. However, it was only with the enactment of the Brazilian Arbitration Act 1996 and with the recognition of the constitutionality of arbitration by the STF, between 1996 and 2002, that its use was consolidated in the country. Nowadays, Brazil is widely recognized as an arbitration friendly functioning jurisdiction.

    Embora a arbitragem exista no Brasil desde a época colonial, foi somente com a promulgação da Lei Brasileira de Arbitragem de 1996 e com a declaração de constitucionalidade de tal instituto pelo STF, entre 1996 e 2002, que a arbitragem passou a se consolidar no País. Atualmente o Brasil é reconhecido como sendo uma jurisdição largamente favorável à arbitragem.
