      This study aims to examine the relevance of someconcepts, principles, legal institutes and documents of internationallaw that were decisive for the formulation and implementation ofthe Unifed Health System (SUS), a public policy that concretizesthe right to health provided for in the Brazilian Constitution 1988.The principle of human dignity makes it a duty of the BrazilianConstitutional State to provide concrete social health servicesin order to protect, promote and realize full citizenship, includinghaving fnancial resources to implement and implement publicpolicies, which are an instrument proactive. The study starts fromthe following problem: what concepts, principles, legal institutes andinternational legal frameworks establish the Brazilian State’s duty toguarantee citizens the right to health? The following conclusionsare reached: The Universal Declaration of Human Rights (1948), theConstitution of the World Health Organization (1946), as well as theconcepts of fundamental rights, Social Constitutional State and theprinciples of human dignity and the minimum existential were ofgreat relevance to the formulation of the 1988 Brazilian Constitution,as they establish the constitutional parameters for the realizationof fundamental rights, including the right to health. It is theoreticalresearch, bibliographic, doctrinal and jurisprudential review.

      Este estudo tem por objetivo examinar a relevância de alguns conceitos, princípios, institutos jurídicos e documentos do Direito Internacional que foram determinantes para a formulação e implementação do Sistema Único de Saúde (SUS), política pública que concretiza o direito à saúde, previsto na Constituição brasileira de 1988. O princípio da dignidade humana transforma em obrigação do Estado Constitucional brasileiro a prestação concreta de serviços sociais de saúde, a fim de proteger, promover e realizar a plena cidadania, inclusive dispondo de recursos financeiros para implementar e efetivar as políticas públicas, que são um instrumento proativo. O estudo parte do seguinte problema: quais conceitos, princípios, institutos jurídicos e marcos jurídicos internacionais fxam ao Estado brasileiro o dever de garantir aos cidadãos o direito à saúde? Chega-se as seguintes conclusões: A Declaração Universal do Direitos Humanos (1948), a Constituição da Organização Mundial da Saúde (1946), assim como os conceitos de direitos fundamentais, Estado Constitucional e Social e os princípios da dignidade humana e do mínimo existencial foram de grande relevância para a formulação da Constituição brasileira de 1988, pois estabelecem os parâmetros constitucionais para a concretização dos direitos fundamentais, incluindo o direito à saúde. Trata-se de pesquisa teórica, de revisão bibliográfica, doutrinária e jurisprudencial.
