    The present work has as its theme the gender clauses inserted in the regulation of electoral systems and seeks to analyze the effectiveness of such clauses in the Brazilian and Portuguese legal systems. To do so, we will use legislative research, analyzing the diplomas that deal with the question, using the techniques of legal hermeneutics to interpret them, bibliographical research on the doctrinaire production on the subject and statistical data of the electoral elections.  The research revealed the greater effectiveness of the Portuguese system, which currently achieves a female occupation of seats in parliament very close to the legal index, which is due in large part to the closed list voting system. The main contribution of the present work, far from exhausting the subject, is the call for reflection and discussion on the theme of gender equality in the participation of political decisions of the nation.

    O presente trabalho tem como tema a análise das cláusulas de reserva de gênero inseridas no regramento dos sistemas eleitorais e busca analisar a efetividade de tais cláusulas no âmbito do ordenamento jurídico brasileiro e português. Para isso, nos utilizaremos da pesquisa legislativa, analisando os diplomas que tratam da questão, usando das técnicas de hermenêutica jurídica para interpretá-los, pesquisa bibliográfica acerca da produção doutrinária a respeito da temática e de dados estatísticos dos pleitos eleitorais.  A pesquisa revelou a maior efetividade do sistema português que atualmente atinge uma ocupação feminina das cadeiras do parlamento bem próxima do índice legal, o que se deve, em muito, ao sistema de voto em lista fechada. O principal contributo do presente trabalho, longe de esgotar o assunto, é o chamado à reflexão e à discussão acerca do tema da igualdade de gênero na participação das decisões políticas da nação.
