A governança multinível na proteção do direito fundamental ao ambiente da União Europeia: o Pacto Ecológico Europeu e o projeto Cities Mission

    A União Europeia, enquanto entidade sui generis, procura lidar com as ameaças globais e contribuir para a sua resolução ou mitigação. No entanto, tem tentado exercer essa agência através de alternativas estratégicas com o objetivo de delinear formas inovadoras de conceber o exercício da autoridade e poder, sem colocar em causa a legitimidade de todo o processo, nomeadamente através da governança multinível, como forma de potenciar políticas e normas mais eficazes perante os desafios deste século – como é o caso das alterações climáticas. Assim, o presente artigo pretende testar a menos estudada articulação de governança entre os níveis supraestadual e subnacional no domínio de um bem público transnacional de especial premência que é o da proteção ambiental. Para tal, procurar-se-á responder à seguinte questão de investigação: de que forma e com que resultados a União Europeia aplica uma estratégia de governança multinível, no âmbito da ação de proteção contra as alterações climáticas, em articulação com os níveis estadual e subnacional? A atuação da União Europeia, especialmente no âmbito do Projeto Cities Mission, constituem o estudo de caso selecionado, ao qual se acrescenta a análise normativa e a revisão da literatura, numa abordagem de natureza indutiva que pretende apreciar a operacionalização da governança multinível por esta organização supranacional.

    The European Union, as a sui generis entity, seeks to deal with global threats and to contribute to their resolution or mitigation. However, it has tried to exercise this agency through strategic alternatives with the aim of outlining innovative ways of conceiving the exercise of authority and power, without jeopardizing the legitimacy of the process, namely through multilevel governance, as a way of enhancing more effective policies and norms before the challenges of this century – such as climate change. Thus, the present article intends to test the less studied articulation of governance between the supra-state and subnational levels in the domain of a transnational public good of special urgency, which is that of environmental protection. To this end, the following research question arises: in what way and with what results does the European Union apply a multilevel governance strategy to foster the protection against climate change, in articulation with the state and subnational levels? The action of the European Union, namely within the scope of the Cities Mission Project, constitutes the selected case study, to which normative analysis and literature review are added, in an inductive approach that intends to appreciate the operationalization of multilevel governance by this supranational institution.
