    Partiendo de la base de que el fletamento por tiempo de células o espacios en buques portacontenedores es un fletamento por tiempo convencional, donde las particularidades no san tanto jurídicas, sino técnicas —derivadas de las especialidades estructurales de los buques portacontenedores y del empleo de contenedores en el contexto de un fletamento en «Time Charter»— no es tanto este contrato el que cambia, cuanto las circunstancias, como la consideración de los propios contenedores como posibles pertenencias del buque. Por otra parte, hay que poner de relieve el hecho de que la gestión comercial atribuida al fletador no está tan alejada de la gestión náutica como pudiese parecer, de forma que el poder de control náutico que ostenta el fletante es el instrumento que permite al fletador un disfrute efectivo del control comercial.

    On the basis that the Time chartering of cells or spaces in container ships is a conventional Time chartering in conventional —though specialized— time charterparty, where the particularities are not so much legal, but technical —derived from the structural specialities of container ships and the use of containers in the context of a «Time Charterparty»— it is not so much this contract that changes, as the circumstances and the consideration of the containers themselves as possible belongings of the ship. On the other hand, it should be emphasised that the commercial management attributed to the charterer is not as far removed from nautical management as it might seem, so that the power of nautical control held by the charterer is the instrument that allows the charterer to effectively enjoy commercial control.
