    The paperprovidesa brief overview of the structure of personality rights, moral dam-ages and their pecuniary compensation, and an ethical critique is drawn from Emmanuel Lévinas on the reduction of the Other to the same. Thus, the question that guides this research is to ana-lyze how pecuniary compensation can convert what is unique to the human person into some-thing homogeneous? Or how you can reduce the Other to thesame. The working hypothesis is that the tendency to indemnify moral damages puts at risk the uniqueness of the person as the same. The general objective is to develop an ethical critique of pecuniary compensation for moral damages. As specific objectives, there are the following: a) the exposition of a general panorama of personality rights and moral damages; and b) the ethical analysis of the general panorama from the philosophy of Emmanuel Lévinas. The research methodology used is the phenomeno-logical one, in which the intersubjective perspective of the projection of the Other with the Self is investigated. The sources that will be used for the development of the research are essentially bibliographic sources, especially in the works of Emmanuel Lévinas,as well as adherent works to the research object. At the end of the investigation, it is observed that the reflection of the uniqueness of the human person demands constant self-criticism in order to avoid its axiological emptying by the functional dimension

    O artigo apresenta um breve panorama da estrutura dos direitos da personalidade, dos danos morais e da sua compensação pecuniária, e traça-se uma crítica ética a partir de Emmanuel Lévinas sobre a redução do Outro ao mesmo. Desta forma, a pergunta que orienta esta pesquisa é analisar como a compensação pecuniária pode converter aquilo que é singular da pessoa hu-mana em algo homogêneo? Ou como pode reduzir o Outro ao mesmo. A hipótese que se trabalha é de que a tendência indenizatória aos danos morais coloca em risco a singularidade da pessoa como o mesmo.O objetivo geral é desenvolver uma crítica ética sobre a compensação pecuniária dos danos morais. Como objetivos específicos, têm-seos seguintes: a) a exposição de um pano-rama geral dos direitos da personalidade e dos danos morais; e b) a análise ética do panorama geral a partir da filosofia de Emmanuel Lévinas.A metodologia de pesquisa utilizada é a feno-menológica, em que se perquiri a perspectiva intersubjetiva da projeção do Outrocom o Eu. As fontes que serão utilizadas para o desenvolvimento da pesquisa são fontes essencialmente bibli-ográficas, especialmente pelas obras de Emmanuel Lévinas, bem como trabalhos aderentes aoobjetode pesquisa. Ao final da investigação, observa-se que a reflexão da singularidade da pes-soa humana preme pela constante autocrítica a fim de se evitar seu esvaziamento axiológico pela dimensão funcional
